1. Agreement

These Terms and Conditions (“Terms”) govern your use of endomama.com and any purchase from Endo Mama ™, operated by Fly High Coaching, LLC (“Endo Mama,” “we,” “us,” or “our”). By using the site or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site.

2. The brand and eligibility

Endo Mama ™ sells merchandise under the Endo Mama, Endo Warrior, and Ally to Endo Mamas lines. You must be at least 18 years old, or the age of majority in your state, to place an order. You are responsible for the accuracy of the information you provide at checkout.

3. No sale of customer contact information

We do not sell, rent, or trade customer contact information. Using the site or joining our email list does not authorize us to sell your name, email, phone number, or address. Details are in our Privacy Policy.

4. Products, descriptions, and pricing

We try to describe products, colors, and prices accurately. Photographs and on-screen colors can differ from the item you receive because of screens, lighting, and printing. Sizes follow the size guide posted on the site.

Prices are in U.S. dollars unless stated otherwise and may change at any time before you complete checkout. We may correct pricing, tax, or shipping errors even after an order is submitted. If that happens, we will contact you and may cancel the order if you do not wish to proceed.

We do not guarantee that every size, color, or design will stay in stock.

5. Orders, payment, and acceptance

An order is an offer to buy. We may accept or decline an order for reasons including stock, suspected fraud, pricing error, or shipping limits.

Payment is due at checkout through our third-party processor. You represent that you are authorized to use the payment method you submit.

Title and risk of loss pass to you when we deliver the order to the carrier, unless law requires otherwise.

6. Shipping

Shipping options, costs, and estimates appear at checkout. Delivery dates are estimates, not guarantees. Delays caused by the carrier, address errors, weather, or customs are outside our control.

You are responsible for providing a complete, deliverable address. Additional carrier fees for a bad address may be charged to you.

7. Returns, exchanges, and damaged items

Return and exchange rules are posted in our Shipping & Returns policy and are part of these Terms. Unless that policy says otherwise:

- Final Sale: Because items are custom-made at the time of purchase, all sales are final. We cannot accept standard returns or exchanges for a change of mind or incorrect sizes.

- Sizing: Please consult our size charts carefully before ordering, as we cannot accept offer refunds or size swaps once an item is printed.

If an item arrives damaged or incorrect, email [email protected] with your order number and clear photos within 14 days of delivery, so we can process the replacement with our printing partner.

8. Our impact pledge

We intend to direct 20% of profits from Endo Mama merchandise to endometriosis research. “Profits” means net profits after product costs, payment fees, shipping we absorb, refunds, taxes we cannot recover, and ordinary operating expenses of the merch business, calculated in good faith on a periodic basis.

This pledge is a statement of our current business practice. It is not a charitable solicitation in your name, not a tax-deductible donation by you unless we later offer a separate documented program, and not a guarantee of any particular research outcome or recipient in a given month. We may change the recipient organization or timing of transfers. Buying merchandise does not make you a donor of record unless we expressly say so at checkout.

9. Intellectual property

All site content, product designs, logos, and brand names — including Endo Mama, Endo Warrior, Ally to Endo Mamas, and related logos — are owned by us or used with permission. You may not copy, sell, or use them to make competing merchandise, ads, or social accounts that suggest you are Endo Mama ™.

You may share photos of products you purchased for personal, non-commercial use. You may not use our logos as your own.

10. Acceptable use

You agree not to:

- Use the site for fraud, harassment, or unlawful activity

- Scrape the site, overload servers, or attempt to access accounts or data that are not yours

- Post or send content that is defamatory, infringing, or that shares someone else’s private information

- Impersonate Endo Mama ™ or claim an official affiliation you do not have

We may suspend access or cancel orders if we reasonably believe these rules were broken.

11. Reviews and user content

If you submit a review, photo, or comment, you give us a non-exclusive, royalty-free license to use it on the site and in our social channels. You promise the content is yours to share and does not violate anyone’s rights. We may edit or decline to publish user content.

12. Medical and wellness disclaimer

Endo Mama is a merchandise and community brand. We are not a medical provider. Nothing on the site is medical advice, a diagnosis, or a treatment plan for endometriosis or fertility. Products are apparel and goods, not medical devices. Always consult a qualified clinician about your health.

13. Disclaimer of warranties

THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL CODE.

SOME STATES DO NOT ALLOW CERTAIN WARRANTY LIMITATIONS. IN THOSE STATES, THE LIMITATION APPLIES ONLY TO THE EXTENT PERMITTED.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLY HIGH COACHING AND ITS OWNERS, EMPLOYEES, AND VENDORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SITE OR PRODUCTS.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE ORDER GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50) IF YOU MADE NO PURCHASE.

THESE LIMITS DO NOT APPLY TO LIABILITY THAT LAW SAYS CANNOT BE LIMITED.

15. Indemnification

You will defend and indemnify Endo Mama ™ and Fly High Coaching against claims, damages, and reasonable legal fees arising from your misuse of the site, your user content, or your violation of these Terms or the law.

16. Third-party services

Checkout, payments, shipping, and some site features are provided by third parties. Their terms apply to those services. We are not responsible for outages or errors on platforms we do not control.

17. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Except where prohibited, you agree that courts located in Florida will have exclusive jurisdiction over disputes that are not resolved informally.

18. Dispute resolution

Before filing a claim, email [email protected] and give us 30 days to try to resolve the issue. Nothing in these Terms limits either party’s right to seek injunctive relief for misuse of intellectual property or unauthorized use of the site.

If a court finds a class-action waiver or arbitration clause is required to be added later, we will update these Terms and notify users as required.

19. Changes

We may update these Terms at any time. The Effective date will change when we do. If you continue to use the site after an update, the new Terms apply to that use. Orders already accepted are governed by the Terms in effect when you checked out, except where the law requires otherwise.

20. General

If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and us about the site and merchandise purchases. You may not assign your rights without our consent. We may assign these Terms in connection with a sale of the business.
